If the owners may need Edinburgh’s Missing Shares service, pause before telling the contractor to begin the ordinary repair.
The Council’s current factsheet says it will not consider an application once repair work has started. A roofer can be available and the scaffold can already be discussed while the application status is still unresolved.
Immediate danger follows another route
Loose stone or another immediate risk cannot wait for an ordinary application. Edinburgh Council has an unsafe buildings and emergency repairs route. The immediate instruction may cover making the building safe while the wider repair remains unresolved.
For an ordinary common repair, the Council’s Missing Shares service may pay an absent or non-paying owner’s share and recover it from that owner as debt. Section 50 of the Housing (Scotland) Act 2006 contains the legal power. The Council decides whether a particular application meets its current conditions.
